GENERAL INFORMATION RE DOMESTIC VIOLENCE ACTIONS:

 

Domestic violence actions are governed by Family Law Code Sections 6200 et seq. (click here for the California Family Law Code)

 
RELATIONSHIP OF THE PARTIES: Orders under these sections may be obtained the petitioner and the person to be restrained:
  • were married
  • were formerly married
  • are related to each other by blood, marriage, or adoption
  • live together
  • formerly lived together
  • have had a dating or engagement rleationship
  • are parents of a minor child together and an action to establish paternity has been or is being filed
  • are parents of a minor child together and an action to establish or modify child support involving the district attorney has been or is being filed
  • are parents of a minor child together and have signed a Voluntary Declaration of Paternity form regarding the child
GROUNDS FOR THE ACTION: Orders will be granted in cases where the person to be restrained:
  • assaulted or attempted to assault the petitioner or another member of his/her household
  • caused, threatened, or attempted bodily injury to the petitioner or another member of his/her household
  • made the petitioner or another member of his/her household afraid of physical or emotional harm
  • sexually assaulted or attempted to sexually assault the petitioner or another member of his/her household
  • stalked the petitioner
TYPICAL ORDERS GRANTED: In applicable casess the court may grant orders:
  • restraining violence
  • ordering the restrained person to move from the residence shared with the petitioner
  • ordering the restrained person to stay away from the petitioner and members of his/her household
  • ordering the restrained person to relinquish firearms
  • granting control of specified property to the petitioner
  • granting attorney fees
  • ordering restitution of expenses associated with the filing of the action
  • requiring the restrained to undergo batterer's treatment
  • child custody
  • child support
  • attorney fees and costs
  • restitution of costs of bringing a domestic violence action
 


3 LEVELS OF SERVICE

FORMS ONLY
($75)
We provide you with basic forms and instructions for a Domestic Violence action. You prepare and file them. Special forms required by local courts are not included.
ATTORNEY ASSISTED
($250)
We complete the basic papers for you, provide you with basic instructions as to how to file and serve them, and give you up to one hour of attorney time to help you through the process. You represent yourself in court.
FULL REPRESENTATION
($225 Per Hour)
We act as your attorneys of record in all matters associated with your domestic violence including the drafting of all legal pleadings, settlement negotiations, and appearances in court. (Southern California only)
