California Summary Dissolution
Of Marriage- General Information:
There is a quick, easy way to get divorced called "summary
dissolution." You won't have to talk to a judge
and you may not need to hire a lawyer. But remember:
it is in your best interest to see a lawyer about ending
your marriage. You will only have to fill out a few
forms.
Not everyone can get a summary dissolution. Most people
have to get a regular divorce.
To qualify for a summary dissolution you must meet
all the following requirements:
You and your spouse or domestic partner:
-
have been married or been registered
domestic partners less than 5 years on the date you
file your Joint Petition for Summary Dissolution of
Marriage or Notice of Termination of Domestic Partnership
with the Secretary of State;
-
have no children together that were
adopted or born before or during the marriage or partnership
(and neither of us are pregnant now);
-
do not own or have an interest in
any real estate (house, condominium, rental property,
land, or a 1-year lease or option to buy);
-
do not owe more than $4,000 for debts
acquired since the date of your marriage or registration
of your domestic partnership (do not count auto loans);

have less than $32,000 worth of property
acquired during the marriage or domestic partnership

do not have separate property worth
more than $32,000 (do not count money you owe on the
property or auto loans);
-
agree that neither spouse nor domestic
partner will ever get spousal or domestic partner
support; AND
-
have signed an agreement that divides

If you meet these requirements and you are in a domestic
partnership in California, click

In addition, if you are married, either you or your
spouse must have lived in California for the last 6
months and in the county where you file for summary
dissolution for the last 3 months.
You must read the Summary
Dissolution Booklet.
The booklet will help you throughout your case. Also,
you have to swear under "penalty of perjury"
that you have read and understood the booklet.
